If you do not agree to these Terms, please do not use our website. Comfort Care Medical (“Comfort Care,” “we,” “us,” or “our”) reserves the right to update these Terms at any time.

Use of This Website

This website is provided for informational purposes only. The content on this site is intended to give you general information about Comfort Care Medical, our compression garment services, insurance coverage, and related topics. The information on this website does not constitute medical advice, diagnosis, or treatment. Account and Form Submissions

When you submit information through forms on our website — including contact forms, referral forms, insurance verification requests, or appointment requests — you agree to provide accurate, current, and complete information. You are responsible for ensuring the accuracy of the information you submit. We may use the information you provide to contact you, verify your insurance benefits, coordinate your care, and fulfill your requests. Submission of a form does not guarantee insurance coverage, product availability, or appointment scheduling.

SMS Text Messaging Program

Comfort Care Medical offers an SMS text messaging program to communicate important updates about your orders, appointments, and care coordination. By providing your mobile phone number and consenting to receive text messages, you agree to the following terms.

1.1 Program Overview

Our SMS program is transactional in nature — we send messages to facilitate your order processing, appointment scheduling, and care coordination. We do not send marketing or promotional messages. Messages are sent only to patients who have provided explicit consent through our enrollment process.

1.2 Message Types Covered

You may receive the following types of transactional messages:

  • Order confirmation and status updates
  • Appointment reminders and scheduling notifications
  • Consent form reminders (DocuSign or paper)
  • Prescription status updates
  • Payment and billing reminders
  • General care coordination messages
  • Delivery ticket and logistics updates
  • Product exchange or remake notifications

1.3 Consent Collection Methods

We collect your consent to receive SMS messages through one of the following methods: (1) electronic consent via DocuSign forms (primary method for most patients), (2) paper intake forms signed during in-person appointments or mailed to patients without email access, or (3) verbal consent during phone orders (rare, less than 5% of cases). All consent is documented and retained for regulatory compliance.

1.4 Message Frequency and Timing

You can expect to receive approximately 2-5 messages per order during active order processing. Message frequency varies based on your order status and care needs. We respect quiet hours and send messages only between 8:00 AM and 9:00 PM in your local time zone, unless responding to an urgent patient-initiated request.

1.5 Cost Disclosure

Message and data rates may apply. Standard messaging charges from your mobile carrier will apply to any SMS messages you receive from us or send to us. Comfort Care Medical does not charge for SMS messages, but your carrier may. Check with your mobile provider for details about your messaging plan.

1.6 Opt-Out and Help Instructions

You have the right to opt out of SMS messages at any time, for any reason. Per the 2025 TCPA update, we honor opt-out requests made through any reasonable means, not just the STOP keyword. You may opt out using any of the following methods:

  • Text STOP: Reply STOP to any message to immediately unsubscribe
  • Call us: Phone 888-358-1580 and request removal
  • Email us: Send your request to customerservice@comfortcaremd.com
  • Written request: Mail your opt-out request to Comfort Care Medical
  • Informal language: We also honor informal requests like “no more texts,” “leave me alone,” or similar language expressing your desire to stop receiving messages

All opt-out requests will be processed within 10 business days. Once opted out, you will no longer receive SMS messages from us, though we may still contact you via phone or email for critical order updates. For help, reply HELP to any message or contact us at the phone number or email above.

1.7 Opt-In Confirmation Message

After you provide consent, you will receive a confirmation message similar to:

“Comfort Care Medical: Thank you for opting in to SMS updates for your order. You’ll receive 2-5 transactional messages per order (appointment reminders, order status, consent forms, etc.). Message and data rates may apply. Reply STOP to unsubscribe or HELP for support. For questions, call 888-358-1580 or email customerservice@comfortcaremd.com”

This confirmation ensures you understand what messages you will receive and how to opt out if desired.

1.8 Privacy and Data Sharing

We will never sell your mobile phone number to third parties. Your mobile number is shared only with our SMS service provider, who operates under a signed Business Associate Agreement (BAA) for HIPAA compliance. We do not include protected health information (PHI) in SMS messages — all texts contain only general reminders and instructions without specific medical details, diagnoses, or treatment information. 1.9 Service Changes and Updates

We reserve the right to modify, suspend, or discontinue the SMS program at any time, with or without notice. We may also update these SMS terms periodically. Material changes to the SMS program will be communicated via SMS, email, or through updates to this Terms of Service page. Your continued participation in the SMS program after such changes constitutes acceptance of the updated terms.

1.10 Liability and Disclaimers

Comfort Care Medical is not liable for delays or failures in message delivery caused by your mobile carrier, network congestion, phone outages, or other factors beyond our control. We are not responsible for charges from your mobile carrier. You are responsible for ensuring your mobile number remains current in our system and for notifying us of any changes. SMS messages are a convenience and supplement to, but do not replace, other forms of communication regarding your care.

1.11 Record Retention

We retain records of SMS consent, opt-out requests, and message logs for a minimum of 7 years to comply with healthcare regulatory requirements and FCC recordkeeping rules. These records include consent forms (DocuSign audit trails or scanned paper forms), opt-in/opt-out timestamps, and message delivery logs. Records are stored securely and accessed only by authorized personnel for compliance, audit, or patient support purposes.

Intellectual Property

All content on this website, including text, images, graphics, logos, icons, and software, is the property of Comfort Care Medical or its content suppliers and is protected by United States and international copyright, trademark, and other intellectual property laws. You may not reproduce, distribute, modify, create derivative works of, publicly display, or otherwise use any content from this website without our prior written consent, except for personal, non-commercial use such as printing a page for your own reference.

Limitation of Liability

To the fullest extent permitted by applicable law, Comfort Care Medical, its officers, directors, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of, or inability to use, this website or any content, services, or products obtained through this website. Any legal action or proceeding arising under these Terms shall be brought exclusively in the federal or state courts located in the State of Maryland, and you consent to the personal jurisdiction and venue of such courts.

We reserve the right to modify or replace these Terms at any time at our sole discretion. When we make changes, we will update the “Last updated” date at the top of this page. Your continued use of the website after any changes constitutes your acceptance of the new Terms. We encourage you to review these Terms periodically.
